GENERAL TERMS AND CONDITIONS (GTC)
1. Scope
These General Terms and Conditions (hereinafter “GTC”) apply to all contracts for the purchase and delivery of goods concluded between you as the customer (hereinafter “you” or “customer”) and us as the seller (hereinafter “we” or “provider”) via our online shop under the domain www.wunderbohnen.de (hereinafter “online shop”). Deviating, conflicting, or supplementary general terms and conditions of the customer shall only become part of the contract if we have expressly agreed to their validity in writing. This also applies if we carry out the delivery without reservation despite being aware of differing customer terms.
The sale of our products is carried out exclusively to customers residing in the states of the European Union (EU). We reserve the right not to accept orders from other countries. Sales are exclusively directed to adult, fully legally competent natural persons (at least 18 years old). The online shop is not intended for use by minors or legally incompetent persons.
These GTC apply in the version valid at the time of the order. We reserve the right to change the GTC at any time. Changes will be published on our website and apply to future orders.
2. Age restriction
The purchase, sale, and shipping of our products is exclusively intended for persons who are at least 18 years old. By placing an order and completing the ordering process, you as the customer expressly confirm that you are of legal age and meet the requirements for purchase. We reserve the right to request suitable proof of age (e.g. copy of an identity card or another official document) in case of doubt. If proof is not provided or doubts remain, we are entitled to cancel the order and not conclude the contract.
A clear notice regarding age verification is displayed upon entering the online shop. The customer is obliged to observe these instructions. A violation of the age restriction does not exempt us from our verification obligation but does not result in any liability on our part for any consequences.

4. Offer and conclusion of contract
The presentation of products in our online shop constitutes a binding offer to conclude a purchase contract. Prices, descriptions, and images of products are prepared carefully but may vary due to technical or typographical errors. Such deviations entitle us to correction without a contract being concluded.
The contract is concluded when you, as the customer, place the products in the shopping cart, complete the order process, and click the button “order with obligation to pay” or a similarly labeled button. By doing so, you submit a binding offer to purchase the selected products. We accept this offer by sending you an order confirmation by email. This confirmation contains all essential contract details, including ordered products, prices, shipping costs, and delivery address.
If an order cannot be accepted (e.g. due to stock issues or technical errors), we will inform you immediately by email. In this case, no contract is concluded. Payments already made will be refunded immediately.
The contract text (consisting of order data, GTC, and cancellation policy) is stored by us and sent to you by email. You may also access it in your customer account if one has been created.
5. Products and use
Our offered seeds and products are sold exclusively as collector, souvenir, or research items. They are not intended for germination or cultivation.
The customer is solely responsible for informing themselves about the legal regulations of their country of residence regarding possession, import, and use, and for complying with them.
We do not provide legal advice and assume no liability for any use of our products that violates applicable legal regulations.
We reserve the right to refuse or cancel orders if there are indications of misuse or illegal use.
6. Prices and shipping
All prices in our online shop are in euros (€) and include statutory VAT (currently 19% in Germany; national tax rates apply for deliveries to other EU countries). Prices apply at the time of order and exclude shipping costs unless explicitly stated otherwise.
Shipping is carried out to all EU member states. Shipping costs are displayed transparently during the ordering process and depend on the delivery location, weight, and chosen shipping method. The following shipping options are available:
Within Germany:
Standard shipping: €3.99 (large letter with basic tracking, including processing and packaging fee).
Free shipping: From an order value of €50.00 (incl. VAT), shipping within Germany is free.
Other EU countries:
Cheapest shipping: €7.49 (without tracking and without liability). For this method, we assume no liability for lost, damaged, or delayed parcels. The customer bears full risk from handover to the shipping provider.
International standard: €14.49 (with tracking and liability up to €50.00 per shipment unless otherwise insured).
We reserve the right to adjust shipping costs in case of special circumstances (e.g. customs fees or special packaging). Such adjustments will be communicated before contract conclusion. Customs duties, import taxes, or similar charges in other EU countries are borne solely by the customer.
6a. Shipping to non-EU countries (e.g. United Kingdom)
For deliveries to countries outside the European Union, especially the United Kingdom (UK), additional customs duties, import charges, taxes, or other official fees may apply. These are to be borne by the customer and are not included in the purchase price or shipping costs.
The customer is responsible for informing themselves about national import, possession, and usage regulations before placing an order. We assume no responsibility or liability for whether our products may be imported or possessed in the respective destination country.
If a shipment is refused, confiscated, or destroyed due to customs or legal regulations, no refund of the purchase price or shipping costs will be made. Our products are offered exclusively as collector, souvenir, or research items.
7. Payment
We offer the following payment methods: advance bank transfer and PayPal.
Available payment methods are shown during the order process. We reserve the right to exclude individual payment methods in specific cases.
Payment is due immediately upon conclusion of the contract. For advance payment, shipment will only take place after receipt of payment.
Goods remain our property until full payment is received.
8. Delivery
Delivery is made to the address provided within the EU. Delivery times are usually 2–5 working days within Germany and 5–10 working days in other EU countries, depending on the shipping provider and method chosen. These are non-binding estimates and may be delayed due to force majeure, strikes, or supply shortages.
If a product is unavailable, we will inform you immediately by email and offer alternatives or cancel the order partially or entirely. Payments will be refunded. Partial deliveries are permitted if reasonable; no additional shipping costs will arise.
The risk of accidental loss or deterioration passes to the customer upon handover to the shipping provider, unless a shipping method with liability is selected (see section 6).
9. Right of withdrawal and return policy
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day you or a third party designated by you received the goods. In addition, we offer an extended voluntary return policy: you may return products within 30 days of receipt, provided they are unused, undamaged, and in original packaging. Return shipping costs are borne by the customer unless there is an error on our part (e.g. wrong delivery). Returns must be sent to the address stated in the cancellation policy.
10. Warranty and liability
We are liable for defects in accordance with statutory provisions. The warranty period is 2 years from receipt of goods. Defects must be reported immediately upon discovery.
We are fully liable for damages caused by intent or gross negligence, as well as for injury to life, body, or health. In cases of slight negligence, we are only liable for breaches of essential contractual obligations and limited to foreseeable damages typical for the contract. Further liability is excluded unless legally mandatory.
We assume no liability for indirect damages, lost profits, or consequential damages. Liability for data loss is limited to typical recovery costs.
11. Data protection
The protection of your personal data is very important to us. We process data only in accordance with legal requirements (GDPR). Our privacy policy is automatically generated by Shopify and can be viewed on our website: here. It contains detailed information about data collection, processing, usage, and your rights.
12. Final provisions
If any provision of these GTC is invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by one that comes closest to its economic purpose.
German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection laws of the customer’s country of residence remain unaffected.
Place of jurisdiction is Sankt Augustin, Germany, where legally permissible. Consumers may also bring claims before their local courts.
Alternative dispute resolution: EU platform http://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate.
13. Vouchers
Our vouchers are only redeemable in the Wunderbohnen.de online shop and are valid for three years from purchase. Cash payment or interest is excluded. Remaining balances remain on the voucher. Discount codes cannot be used when purchasing vouchers; however, they may be used when redeeming them.
