Affiliate Program – Terms and Conditions (T&Cs)

1. Scope
   These terms and conditions govern the cooperation between wunderbohnen.de – Lea Kühn, c/o Online-Impressum.de #1333, Europaring 90, 53757 Sankt Augustin (hereinafter "Provider") and the participants of the Affiliate Program (hereinafter "Affiliate").

2. Conditions for Participation
   Eligible participants are natural persons aged 18 or over and legal entities. Registration takes place via the provided Affiliate portal. New affiliate registrations must be manually approved by the Provider before activation. There is no entitlement to admission. The Provider reserves the right to reject or exclude Affiliates without stating reasons, especially in case of violations of these terms.

3. Commission Model
   The standard commission is 10 percent of the discounted net value of goods per successful and paid order. From a monthly sales volume of ten orders, individual, higher commission rates starting from 15 percent can be agreed upon.
   Serious Seeds products are completely excluded from discount promotions, coupons, and affiliate codes. For sales of Serious Seeds products via the affiliate link, the Affiliate receives a fixed commission of 5 percent. This also applies if customers order both Serious Seeds products and other products together and use an affiliate coupon. These special conditions may be adjusted in the future. Changes will be communicated in good time.
   Cancelled, returned, or unpaid orders are not eligible for commission.

4. Payout and Payment Modalities
   Commissions will be paid out no earlier than 30 days after receipt of the commission-eligible order. There is no minimum payout amount. Payouts are made by bank transfer or PayPal, with any applicable fees to be borne by the Affiliate. Billing is done by credit note from us. The Provider may withhold payouts until outstanding issues or suspected cases are clarified.

5. Obligations of the Affiliate
   The Affiliate undertakes not to use spam methods, misleading advertising, or unfair practices. The use of illegal, offensive, discriminatory, or trademark-infringing content is prohibited. Advertising must not be associated with unlawful content. The Affiliate must not represent themselves as an official representative of the Provider.
   Affiliates may use the images and graphics provided by the Provider for Spice of Life Seeds and Seeds of Anarchy for marketing purposes within the scope of their affiliate code. However, it is not permitted to present these materials as their own imagery or as photos of their own plants.

6. Termination
   Both parties can terminate the cooperation at any time with immediate effect. In case of violations of these terms, the Provider can block Affiliates without prior notice. Legally acquired open commissions will be paid out even after termination of the cooperation.

7. Liability
   The Provider is not liable for indirect damages, lost profits, or consequential damages. Liability is limited to intentional or grossly negligent conduct.

8. Changes to the Terms
   The Provider may change these terms and conditions at any time. Affiliates will be informed about changes. Continued participation constitutes acceptance.

9. Jurisdiction and Applicable Law
   German law applies exclusively. The place of jurisdiction is, as far as legally permissible, the Provider's registered office.

10. Payout Requirements

    Payout of affiliate commissions will only occur when all required information of the affiliate is complete. This includes, in particular, name, full address, and – if applicable – tax details (e.g., tax ID or VAT ID).

    The affiliate is obliged to keep their data correct and up-to-date. As long as this information is incomplete, there is no entitlement to payout.

    Commissions are settled using the credit note procedure.
